General Terms and Conditions (GTC)

These General Terms and Conditions govern the use and purchase of digital products, courses and related services offered through Myron Athletics.

By completing an order, the customer accepts these General Terms and Conditions in the version applicable at the time of the order.

1. Provider

The provider of the online store and contractual partner of the customer is:

Hereinafter referred to as “Myron Athletics” or “MYRON”.

2. Scope

These General Terms and Conditions apply to all contracts concluded through the Myron Athletics online store concerning digital products, digital courses and related digital services.

At present, digital jump rope training programs and associated digital content are offered in particular.

If physical products such as jump ropes are offered in the future, additional or amended terms may apply to such products.

Any differing terms and conditions of the customer shall only apply if Myron Athletics has expressly agreed to them.

Mandatory statutory consumer rights remain unaffected at all times.

3. Requirements for Purchase

Customers must be legally entitled to enter into the respective contract.

Persons who are not yet fully legally competent under the applicable law may only make a purchase with the required consent of their parents, legal guardians or other persons legally authorized to provide such consent.

By placing an order, the customer confirms that they are legally entitled to enter into the contract or that the required consent has been obtained.

4. Offer and Conclusion of Contract

The essential characteristics, content and prices of the respective product are displayed on the corresponding product page and during the ordering process.

Before completing the order, the customer has the opportunity to review their information and the contents of their order and to correct them if necessary.

By clicking the button that clearly indicates the obligation to pay, the customer submits a binding order.

The contract is concluded no later than when Myron Athletics electronically confirms the order or provides the customer with access to the purchased digital product.

After completing the order, the customer receives an electronic confirmation at the email address provided during the order process.

The customer is responsible for providing a correct and accessible email address when placing the order.

5. Subject Matter of the Contract

The subject matter of the contract is the digital course or digital offer described on the respective product page.

For the currently offered 30-Day Freestyle Jump Rope Program, this includes in particular access to the training content, videos, slow-motion content, challenges, digital materials and other components expressly described on the product page.

The specific scope of services is determined by the product description displayed at the time of the order.

Advertising statements or content outside the product description shall only create an additional entitlement if they are expressly identified as part of the purchased offer.

6. Prices

The price displayed in the online store at the time of the order shall apply.

The currency applicable to the customer as well as taxes or other price components charged by Myron Athletics shall be displayed no later than before completion of the order.

The total price of the order shall be displayed to the customer before the order becomes subject to payment.

Depending on the customer’s place of residence, payment method, bank or currency used, external payment or currency conversion fees may apply. Such fees may be charged by the relevant payment, card or financial service provider and are outside the control of Myron Athletics.

Price changes do not affect orders that have already been validly concluded.

7. Payment Methods

The payment methods available in the respective country are displayed during checkout.

Available payment methods may include, in particular, Shopify Payments, credit or debit cards and PayPal.

Depending on the country or technical availability, additional payment methods may be offered or individual payment methods may not be available.

The terms and conditions of the respective payment service provider may also apply to payment processing.

In the event of a failed, rejected or incomplete payment, there is no entitlement to activation of the digital product until the amount owed has been successfully paid.

8. Provision of the Digital Course

After successful completion of the order and payment, the digital course is generally provided immediately or without undue delay.

The customer may, in particular, receive an email containing access information, a PDF or further information and may be given access to the relevant digital course area.

If the customer is unable to access the purchased content due to a technical problem, they should contact Myron Athletics at support@myronathletics.com.

Myron Athletics will review legitimate technical access problems within a reasonable period of time and, where possible, resolve them.

9. Duration of Course Access

The purchase of the currently offered digital course includes guaranteed access for 12 months from the date of purchase.

The date of purchase shall generally be the date of the successful order or the electronic order confirmation.

After the expiry of these 12 months, the contractually guaranteed access to the online course ends automatically.

This does not create a subscription or any automatic paid renewal.

Myron Athletics may voluntarily allow access beyond the 12-month period. However, such voluntary extension does not create any entitlement to a further or permanent extension.

Materials expressly made available for download and lawfully downloaded by the customer during the access period may continue to be used afterwards within the scope of the personal rights of use granted under these General Terms and Conditions.

10. Discontinuation or Modification of the Course Platform

Myron Athletics may change the technical platform, presentation or individual technical components of the course or replace them with other solutions.

Individual course content may also be updated, improved, supplemented or technically redesigned.

Such changes must not unreasonably impair the essential contractually agreed benefit of the purchased product during the guaranteed access period.

If the existing platform can no longer be operated during the guaranteed access period, Myron Athletics will, to the extent reasonable and technically possible, attempt to provide functionally comparable access or another suitable form of delivery.

Mandatory statutory claims of the customer in the event of non-provision or defective provision remain unaffected.

11. Personal Support and Video Feedback

Where indicated for the purchased product, customers receive access to personal support from Myron Athletics for 12 months from the date of purchase.

This support may, in particular, be provided through a WhatsApp Business number made available by Myron Athletics.

Customers may use this channel to ask questions about training or the course and submit their own training videos for personal feedback.

The support does not include any entitlement to support being available at all times or around the clock and does not guarantee an immediate response. Requests are handled within a reasonable period of time and depending on the respective volume of inquiries.

Unless expressly offered otherwise, the support does not constitute permanent personal 1-to-1 coaching with a guaranteed number of video analyses, conversations or specific response times.

The entitlement to support generally ends 12 months after the date of purchase. Voluntary support beyond this period does not create any entitlement to further services.

If WhatsApp can no longer or is no longer intended to be used as a support channel in the future, Myron Athletics may offer a comparable means of communication without thereby reducing the essential scope of the promised support.

12. Submitted Videos and Content

If the customer sends videos, images, texts or other content to Myron Athletics for feedback or support, the customer confirms that they are entitled to transmit such content.

If other persons are identifiable in submitted recordings, the customer is responsible for ensuring that the necessary consent of those persons has been obtained.

By submitting a video for analysis, the customer grants Myron Athletics the right to view and process the material to the extent necessary to provide the requested support or feedback.

Submitting a video does not automatically grant Myron Athletics the right to publish the video publicly, use it for advertising purposes or share it on social media.

Any such publication shall only take place with the customer’s separate consent.

13. Customer Account and Access Credentials

Access to the digital course is personal and is generally intended only for the person who purchased the course.

Access credentials, links or customer accounts may not be shared, sold, rented or otherwise transferred to other persons.

The customer is required to take reasonable measures to protect their access credentials from unauthorized access by third parties.

If the customer becomes aware of unauthorized use of their account, they should contact Myron Athletics immediately.

A purchase generally entitles one person to use the course unless expressly stated otherwise on the product page.

14. Copyright and Rights of Use

All course videos, texts, graphics, training plans, PDF files, images, designs, concepts and other content provided by Myron Athletics are protected by copyright and/or other intellectual property rights, insofar as such rights exist.

Upon purchase, the customer receives a personal, non-exclusive and non-transferable right to use the purchased content.

The content may only be used for personal purposes.

In particular, the sharing of access credentials, the sale or distribution of course materials, the publication of complete course content, the provision of the content on other platforms or file-sharing services, as well as commercial reproduction or further exploitation without the prior express consent of Myron Athletics are not permitted.

Filming or recording course content for the purpose of distributing it to third parties is also prohibited.

15. Misuse of Access

Where there is reasonable suspicion of significant unauthorized sharing or commercial exploitation of course content, Myron Athletics may take appropriate measures to protect the offer.

In the event of a material breach of contract, this may also include the temporary suspension of access.

Where the circumstances allow, the customer will first be given an opportunity to explain the situation or cease the breach of contract.

In cases of serious misuse, fraud, security risks or intentional unauthorized distribution of course content, immediate suspension may be necessary.

Mandatory statutory rights of the customer remain unaffected.

16. Training Information and Health Requirements

The course contains sports-related training content, in particular exercises in the field of jump rope and freestyle jump rope.

The content is intended for sports instruction and education and does not constitute a medical diagnosis, medical treatment or individualized medical advice.

Each participant is responsible for appropriately taking their own physical condition and personal limits into account.

Persons with existing health conditions, injuries, cardiovascular problems or other health concerns should seek qualified medical advice before starting or continuing the training.

If symptoms such as pain, unusual dizziness, shortness of breath or other health complaints occur during training, the training should be stopped and medical advice should be sought where appropriate.

The customer is also responsible for ensuring a suitable training environment, sufficient space and appropriate training equipment.

These provisions do not limit any liability that cannot be excluded or restricted under mandatory law.

17. Training Results

Myron Athletics provides training methods, exercises and experience intended to help customers develop and improve their jump rope skills.

However, no specific training result can be guaranteed.

Progress varies from person to person and depends, among other things, on training frequency, physical condition, previous experience, technique, recovery and individual implementation.

Statements regarding possible progress or results therefore do not constitute a guarantee of any particular personal result unless expressly stated otherwise.

18. Technical Requirements

To use the digital course, the customer requires a suitable internet-enabled device, a functioning internet connection, an accessible email address and, where applicable, an up-to-date web browser.

Individual functions may require additional technical requirements.

The customer is responsible for their own internet connection, device and the proper functioning of that device.

Technical problems caused exclusively by the customer’s device, software, internet connection or settings do not generally constitute a defect in the digital course.

Myron Athletics will, however, provide reasonable assistance in identifying common access problems where possible.

19. Maintenance and Temporary Interruptions

Maintenance work, updates or temporary technical interruptions may occasionally occur.

Myron Athletics will endeavor to keep such disruptions to a minimum.

A temporary and reasonable technical interruption does not automatically create an entitlement to a refund.

However, if an impairment continues for a substantial period or a contractually owed digital service cannot be properly provided, the customer’s statutory rights remain unaffected.

20. Warranty for Digital Content

Myron Athletics is responsible for providing the contractually agreed digital content to the agreed extent.

If the course or an essential part of it is inaccessible due to an error attributable to Myron Athletics or materially deviates from the contractually agreed service, the customer should first inform Myron Athletics of the problem.

This gives Myron Athletics the opportunity to remedy the problem within a reasonable period of time or otherwise restore the service to conformity with the contract.

Statutory rights to have conformity restored, receive a price reduction, terminate the contract, obtain a refund or exercise other remedies remain available insofar as they are provided for under the applicable mandatory law.

21. Withdrawal and Refunds

The withdrawal policy or withdrawal provisions published in the online store apply additionally to withdrawals and refunds.

Myron Athletics generally does not offer a voluntary money-back guarantee or voluntary refund for digital courses that have already been made available due to a change of mind, non-use or failure to complete the course.

This applies only to the extent permitted by law.

Where a customer is entitled to a statutory right of withdrawal due to their place of residence or applicable mandatory consumer law, such rights remain unaffected.

For digital content, a statutory right of withdrawal may expire under the applicable legal requirements once immediate provision of the digital content begins, provided that the customer has previously given the required express consent and has acknowledged the corresponding loss of the right of withdrawal.

If the legally required conditions are not met, the corresponding statutory consumer rights remain in force.

Incorrect duplicate charges or other demonstrable billing errors will be corrected independently of the above.

22. No Subscription

Unless expressly stated otherwise on the relevant product page, the purchase of the digital course is a one-time payment.

There is no automatically renewing subscription.

Therefore, after the agreed 12-month access period expires, no additional payment will be charged automatically.

23. Promotions, Discounts and Vouchers

Time-limited promotions, vouchers or discount codes may be subject to additional conditions stated in connection with the respective offer.

Discounts are generally not applied retroactively to purchases that have already been completed unless Myron Athletics expressly agrees otherwise.

There is no entitlement to cash payment of an unused discount code unless mandatory law provides otherwise.

24. Liability

Myron Athletics is liable in accordance with the applicable statutory provisions.

Liability for damage caused intentionally or through gross negligence is not excluded.

Mandatory statutory liability provisions also remain unaffected, in particular where exclusion of liability for personal injury or damage to health is not legally permitted.

To the extent permitted by law, Myron Athletics shall not be liable for damage arising exclusively because the customer applies training instructions in an obviously improper manner, disregards personal health limitations, creates unsuitable training conditions or uses content in breach of these General Terms and Conditions.

Myron Athletics is also not liable for disruptions caused by independent third-party providers where such disruptions are outside the reasonable control of Myron Athletics. Myron Athletics’ own statutory obligations toward the customer remain unaffected.

25. Third-Party Providers

Third-party services may be used for the operation of the online store and individual services, for example Shopify, payment providers or WhatsApp.

When using such services, their own terms and conditions and privacy policies may also apply.

Myron Athletics is not responsible for independent services provided by a third party insofar as those services do not form part of the services owed by Myron Athletics to the customer.

However, this does not limit any mandatory claims the customer may have against Myron Athletics in relation to a service owed by Myron Athletics.

26. Data Protection

Personal data is processed in accordance with the Privacy Policy published in the online store.

This applies in particular to data in connection with orders, customer accounts, course access, support inquiries and the technical service providers used.

Use of WhatsApp support is voluntary. When WhatsApp is used, data may additionally be processed by the operator of WhatsApp.

27. Changes to the General Terms and Conditions

Myron Athletics may amend these General Terms and Conditions for future orders, in particular if the offer, technologies used or legal requirements change.

For a purchase that has already been concluded, the version of the General Terms and Conditions agreed at the time the contract was concluded shall generally apply.

A later amendment to these General Terms and Conditions may not retroactively remove essential rights already acquired by the customer without an appropriate legal or contractual basis.

28. Priority in the Event of Conflicting Information

If specific information on the product page at the time of purchase differs from a general provision of these General Terms and Conditions, the more specific product information shall generally prevail, provided that it was validly agreed.

Mandatory statutory provisions remain unaffected.

29. Applicable Law

The contractual relationship is generally governed by Swiss law.

However, in the case of consumers, this choice of law shall apply only insofar as it does not deprive them of mandatory protections granted to them under the law applicable on the basis of their habitual residence.

Mandatory national and international consumer protection provisions therefore remain expressly reserved.

30. Jurisdiction

The jurisdictions provided for by law apply to disputes.

In the case of consumers, in particular, all mandatory statutory jurisdictions at their place of residence or habitual residence remain unaffected.

To the extent that an agreement on jurisdiction is legally permitted and the customer is not a consumer benefiting from a mandatory statutory place of jurisdiction, the place of jurisdiction shall be Biel/Bienne, Switzerland.

31. Severability Clause

If individual provisions of these General Terms and Conditions are wholly or partially invalid or unenforceable, the remaining provisions shall remain effective to the extent permitted by law.

The applicable statutory provisions shall take the place of any invalid provision.
